Welcome to Joggy (the "App"), a photo collage and image styling application developed and operated by [Developer Name] ("we", "us", "our"). By downloading, installing, or using the App, you ("User", "you") agree to be bound by this User Agreement (the "Agreement") and our Privacy Policy. If you do not agree to these terms, you must not use the App. This Agreement complies with the laws of the United Kingdom, including but not limited to the Consumer Rights Act 2015, the Digital Services Act, and the General Data Protection Regulation (UK GDPR).
The App is provided free of charge, with optional in-app features (e.g., saving creations using in-app coins) subject to the terms outlined herein. No account registration is required to access the App’s core functionality.
2.1 The App allows Users to: (a) create photo collages using flexible layouts (2x2, 3x3, 4x4 grids; vertical/horizontal arrangements); (b) edit photos (reposition, zoom, crop); (c) apply curated filters (Vintage, Warm, Bright, Soft, Classic, Sepia, Noir, Cool); (d) save creations using in-app coins; (e) track editing history; and (f) edit photos locally on the User’s device.
2.2 We grant you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only. You may not: (a) modify, reverse engineer, decompile, or disassemble the App; (b) use the App for commercial gain without prior written consent; (c) share, distribute, or sublicense the App to third parties; (d) use the App to upload or process illegal, offensive, or infringing content (including but not limited to content that violates copyright, trademark, or privacy laws); or (e) interfere with the App’s functionality or security.
3.1 The App uses "in-app coins" ("Coins") to enable certain features, such as saving creations. Coins may be obtained through: (a) in-app purchases; (b) promotional offers; or (c) other methods specified by us. All Coin purchases are final and non-refundable, except as required by UK law (e.g., under the Consumer Contracts Regulations 2013 for digital content with defects).
3.2 Coins have no monetary value, are non-transferable between Users, and cannot be exchanged for cash or other forms of currency. We reserve the right to modify the number of Coins required for features, or to discontinue Coins, with reasonable notice to Users.
4.1 You retain full ownership of all photos, collages, and other content you create or upload using the App ("User Content"). By using the App, you grant us a limited, non-exclusive license to process User Content solely to provide the App’s functionality (e.g., rendering collages, applying filters) and to store User Content locally on your device. We do not access, store, or process User Content on our servers (see Privacy Policy for details).
4.2 The App’s intellectual property rights (including but not limited to software, design, trademarks, logos, and filters) are owned by us or our licensors. You may not use any of our intellectual property without prior written permission.
4.3 You are solely responsible for ensuring that your User Content does not infringe the rights of third parties (e.g., copyright, privacy, or publicity rights). We are not liable for any claims arising from your User Content.
5.1 We respect your privacy and comply with the UK GDPR and Data Protection Act 2018. The App processes data locally on your device and does not collect or transmit personal data to our servers unless explicitly stated in our Privacy Policy. 5.2 You acknowledge that you are responsible for securing your device and any User Content stored on it. We are not liable for unauthorized access to your device or User Content.
6.1 The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be error-free, uninterrupted, or secure.
6.2 To the maximum extent permitted by UK law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the App, including but not limited to damages for loss of data, loss of profits, or device damage. Our total liability to you shall not exceed £100.
6.3 Nothing in this Agreement shall exclude or limit our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) breach of statutory duties; or (d) any other liability that cannot be excluded by law.
7.1 We may terminate or suspend your access to the App at any time, without notice, if you violate this Agreement. Upon termination, your license to use the App shall cease, and you must delete the App from your device.
7.2 You may terminate this Agreement at any time by deleting the App from your device. Termination shall not affect any rights or obligations that accrued prior to termination.
We reserve the right to modify this Agreement at any time. When we make changes, we will update the "Effective Date" at the top of this Agreement and notify you via the App or email (if you provide contact information). Your continued use of the App after the changes take effect constitutes acceptance of the modified Agreement. If you do not agree to the changes, you must stop using the App.
This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that you may also bring proceedings in the courts of your country of residence if required by local law.
